Terms of Service
These Terms of Service ("Terms") are an agreement between you and WLODigital LLC ("we", "us"), which operates StoryInkling at www.storyinkling.com (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use StoryInkling
You must be at least 18 years old, or the age of majority where you live, to create an account. You are responsible for keeping access to your email account secure, because we sign you in by email link.
2. What the Service does
StoryInkling uses artificial intelligence ("AI") to help you plan, write, revise, review, and format fiction and memoir, and to create cover art. The Service may change, and features may be added, changed, or removed.
3. AI-generated content
- AI output can be inaccurate, inconsistent, unoriginal, or unsuitable. We do not guarantee that anything the Service produces is accurate, original, free of errors, or fit for any purpose, including publication.
- Similar prompts may produce similar output for other users. We do not guarantee that output is unique to you.
- You are responsible for reviewing, editing, and deciding whether to publish anything you create. If you publish a book, you are responsible for complying with the rules of the publishing platform you use, including any requirement to disclose the use of AI.
- For memoir, you are responsible for the truth of what you publish and for the privacy of real people you write about.
4. Your content
You keep ownership of the brainstorms, writing, and manuscripts you provide, and, as between you and us, of the books the Service helps you create, to the extent the law allows ownership of AI-assisted work. You give us a limited license to store, process, and transmit your content only as needed to operate the Service for you, including sending it to the AI providers listed in our Privacy Policy. You confirm that you have the right to use anything you upload or provide, and that it does not infringe anyone else's rights.
5. Acceptable use
You agree not to use the Service to create or upload content that is unlawful, infringes anyone's rights, sexually exploits minors, harasses or defames real people, or that the Service's safety rules do not allow (including explicit sexual content); to attempt to break, overload, or get around the Service's security, limits, or credit system; or to resell the Service without our permission. We may suspend or close accounts that break these rules.
6. Memberships, credits, and payment
- Credits. AI features use credits. The credits each action uses are shown in the Service.
- Free accounts receive a one-time gift of starter credits and can write short stories. Starter credits do not renew.
- Paid plans renew monthly until canceled and include a monthly credit allowance. Monthly credits reset at each renewal and unused monthly credits do not roll over.
- Credit packs are one-time purchases. Pack credits do not expire while your account is open.
- If an AI job fails or you stop it, the credits it used are returned. Otherwise credits, plans, and packs are non-refundable except where the law requires. [CONFIRM REFUND POLICY]
- Credits have no cash value and cannot be transferred. We may change prices and credit costs with notice; changes apply from your next renewal or purchase.
7. Ending your account
You can stop using the Service at any time and ask us to delete your account. We may suspend or end your access if you break these Terms. When an account ends, unused credits are lost.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the Service will be uninterrupted, error-free, or that your content will never be lost; keep copies of anything important.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WLODigital LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY CONTENT IT PRODUCES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $50 IF GREATER.
10. Indemnification (hold harmless)
You agree to defend, indemnify, and hold harmless WLODigital LLC and its owners and contractors from any claims, damages, losses, and costs (including reasonable legal fees) arising from your content, your publication or other use of anything you create with the Service, or your breach of these Terms.
11. Changes to these Terms
We may update these Terms. When we do, we will ask you to review and accept the new version before you continue using the Service.
12. Governing law
